The general conditions of sale described below form an integral part of any contract, verbal or written, concluded between the company VIETNAM ESCAPADE (hereinafter referred to as Vietnam Escapade) and a physical person or legal entity (hereinafter referred to as “the client” ).
In the absence of any other agreement / contract signed between Vietnam Escapade and the customer, the agreement / contract between Vietnam escapade and the customer is governed entirely by these General Conditions of Sale, which is the purchase commitment of Travel or services.
1. VALIDITY OF PRICES
All prices quoted in the Vietnam Escapade quote are in USD (US Dollars). These prices are valid for the duration specified on the estimate, invoice or any other document of Vietnam Escapade distributed to the customer.
Vietnam Escapade guarantees the validity of the rates, invoices or documents given to the customer at the time of their distribution. However, certain cases of force majeure (large fluctuations in exchange rates, newly promulgated State tax, significant increase in the price of hotels or transport, etc.) may force Vietnam Escapade to readjust its prices in order to respect the travel conditions As described in the quotation. In these cases, a request for a re-adjustment will be sent by Vietnam Escapade to the customer who can either accept it or refuse it. In the event of a refusal by the client, Vietnam Escapade reserves the right to cancel the program and agrees to reimburse the customer for the deposit he had paid.
2. BOOKING AND CONFIRMATION
Any customer confirmation of purchase must be sent by e-mail to Vietnam Escapade. Upon receipt of the customer’s purchase requisition, Vietnam Escapade sends it an acknowledgment of receipt.
The general conditions of sale apply from the date of booking, which is the date on which Vietnam Escapade confirmed the reservation in writing.
3. ADVANCE AND FINAL PAYMENT
A. Advance payment
Upon confirmation of the trip, the inscription must necessarily be accompanied by a down payment of 10% of the total amount of the estimate.
For programs with private junk and / or 5 * hotels, the deposit is represented by a deposit of 20% of the total amount of the estimate.
The date of receipt of the deposit triggers the reservations concerning all the services by Vietnam Escapade.
The Client shall pay to Vietnam Escapade the remaining sum due, the total price of the trip (90% or 80 %%) on the first day of the trip or the first meeting with a Vietnam Escapade official. In the event of non-compliance with this commitment without the Vietnam Escapade agreement, Vietnam Escapade reserves the right to cancel the trip without refund of the deposit paid by the customer. The customer can nevertheless pay for it before the beginning of the journey, according to his wish.
Upon payment of a deposit or balance on the part of the customer, Vietnam Escapade will issue an acknowledgment of receipt which will be given to the customer before or at the arrival of travelers in Vietnam, either by e-mail or by hand, Offices of Vietnam Escapade, or by the guide.
4. METHOD OF PAYMENT
Estimates are in USD (US dollars). Vietnam Escapade accepts payment in the currency of the customer’s choice: US dollar, euro or vietnam dong. Vietnam Escapade will apply the exchange rate in effect on the day of the transaction by referring to www.xe.com
The customer can choose one of the following payment methods:
– Bank transfer to a bank account located in metropolitan France
The bank details of Vietnam Escapade will be communicated to the customer when the service contract is concluded.
– Electronic payment terminal: Payment by credit card via an electronic payment terminal (card machine) is only possible for payment of the balance. In this case, the client must go to the Vietnam Escapade agency with his card. Vietnam Escapade accepts VISA, MASTERCARD, AMERICAN EXPRESS cards. The payment is made by a machine connected directly to the bank (bank charges of 3% of the transaction amount are to be borne by the customer).
– Cash: Payment in cash shall be made to the Vietnam Escapade office or to the persons designated by it. There is no charge for cash settlement.
5. CANCELLATION OR MODIFICATION OF TRAVEL BY CUSTOMER
Any modification of the travel program by the client must reach Vietnam Escapade at least two weeks before the start of the trip.
Modification of the program during the trip is possible, subject to the availability of the requested services. In all cases, the client must take charge of the supplements due to the changes he wishes to make or visits outside the program.
In case of cancellation by the customer for any reason, the client must inform Vietnam Escapade by mail or mail and agrees to pay the cancellation fees which correspond:
– 25% of the deposit if cancellation received within 45 days or more before the start of the journey
– 55% of the deposit if the cancellation received 21 to 45 days before the start of the journey
– 80% of the deposit if the cancellation received 8-20 days before the start of the trip
– 100% of the deposit if the cancellation received less than 8 days before the beginning of the trip
The amounts to be refunded by Vietnam Escapade will be made by bank transfer or check within 14 days of receipt of your cancellation request. Bank charges shall be borne by the customer.
6. CANCELLATION OR MODIFICATION OF TRAVEL BY VIETNAM ESCAPADE
Vietnam Escapade reserves the right to modify or cancel the trip, in whole or in part, when unforeseeable events of force majeure (eg health reasons, policies, natural disasters, air transport, etc.) make the journey impossible Or dangerous for travelers.
In all cases of cancellation, the persons registered in the program of the trip will be fully reimbursed but will not be entitled to any other compensation.
7. INSURANCE AND ASSISTANCE
Vietnam Escapade does not offer Insurance and Assistance. It is highly recommended that any person who participates in a tour organized by Vietnam Escapade to have travel insurance coverage contracted in his country of origin. Vietnam Escapade may have to ask the customer for their insurance certificate and assistance.
Vietnam Escapade undertakes to provide all useful assistance to the customer when events occur, including the completion of formalities with the competent authorities and the insurer.
Vietnam Escapade is committed to providing the client with all the services mentioned in the travel program.
During the journey, the client must respect the rules announced by the guide or the person in charge of the service provider. These rules are intended to ensure the smooth running of the program and are also rules for safety.
Vietnam Escapade is responsible to the customer as an intermediary between the customer and the various service providers (airplanes, hotels, transport operators, restaurants, boats …). Vietnam Escapade must in any case do its best to satisfy the customer, but can not be confused with these various service providers, who in any case retain their own responsibility.
Anything that happens outside the program or the contract is not under the responsibility of Vietnam Escapade.
Vietnam Escapade can not be held responsible for the damaging consequences resulting from an event of force majeure (bad weather, natural catastrophe, a political problem, strike, …).
Vietnam Escapade is not responsible for customer’s customs problems due to breach of regulations.
Vietnam Escapade is not responsible for theft or loss of valuables or personal property due to the customer’s negligence.
Some tours of Vietnam Escapade include activities that require special attention. These activities include embarkation and disembarkation, climbing of hills, entrance and exit of caves, etc. Our guides will assist or give advice to their clients, but the risks involved in these activities are the responsibility of the clients themselves.
Any interrupted or abbreviated journey, or any service not used by the customer, can not be refunded.
However, if the trip is interrupted in whole or in part for health reasons, Vietnam Escapade undertakes to do its best to obtain from the service providers the total or partial reimbursement of the costs of the services not consumed.
10.COMPLAINTS OR DISPUTES
If the client is dissatisfied with certain Vietnam Escapade services, he / she is advised to inform his / her travel guide or travel adviser that similar problems will not occur during the trip.
In the event that there is a complaint or complaint relating to a trip or a stay, the client must inform Vietnam Escapade within 15 days from the end of the trip, by registered mail with acknowledgment of receipt or by mail. The supporting evidence must be attached to the letter of claim. Vietnam Escapade will not take into account claims made after 15 days the end of your trip.
Any dispute between the customer and Vietnam Escapade must be settled by priority through negotiation.
If no amicable solution can be found, the court of the place of performance of the contract shall have jurisdiction to decide the dispute.
